These Terms and Conditions (“Terms”) govern your use of Cashwo, operated by PayAny1 Pty Ltd (ABN 51 630 466 303 AFSL No. 518990). By accessing or using our payment gateway services, you agree to these Terms, our Financial Services Guide (FSG), and Product Disclosure Statement (PDS), all available at www.cashwo.com.au.
1.1 AFSL – Australian Financial Services License No. 518990 held by PayAny1 Pty Ltd.
1.2 Cashwo – The financial services platform offering non-cash payment solutions viaPayTo technology.
1.3 PayTo – A payment service allowing businesses to collect funds directly from customers’bank accounts with authorization.
1.4 Business User – A registered business using Cashwo’s payment services.
1.5 Customer – An individual making payments to a Business User via Cashwo.
1.6 Unauthorized Transaction – Any transaction made without the user’s consent.
2.1 Cashwo provides a web-based payment gateway enabling Business Users to collect fixed-amount recurring payments from their Customers via PayTo Agreements.
2.2 Cashwo does not hold or custody any funds. All direct-debits flow from the Customer’s bank directly to the Business User’s nominated account.
2.3 Business Users access the Cashwo web portal to create and manage PayTo Agreements, view pending and settled transactions, and configure notification preferences.
3.1 Only Australian-registered businesses may register as Business Users.
3.2 Business Users must complete identity verification in accordance with AML/CTF laws beforeactivating PayTo Agreements.
3.3 Each Business User account must be linked to a verified business bank account; personal accounts are not permitted.
4.1 Free Trial: First three months of service at no charge.
4.2 Monthly Service Fee (after trial): $50/month for up to 30 transactions.
4.3 Additional Transaction Fee: $0.99 per transaction beyond 30 in any calendar month.
4.4 Settlement Fee: No fee for standard settlement to your nominated bank account.
4.5 All fees are exclusive of GST. Cashwo may change fees with 30 days’ notice via the web portal.
5.1 Direct-debits occur automatically on the schedule set in each PayTo Agreement. The debit amount and frequency cannot be altered once the Agreement is active.
5.2 Funds are generally credited to the Business User’s nominated bank account within 24 hours of a successful debit, subject to banking hours and NPP participation.
5.3 Cashwo will automatically retry failed debits up to three times on successive days. Business Users may view retry attempts in the portal.
6.1 Cashwo complies with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
6.2 Business Users must provide accurate information for identity verification. Cashwo may delay, block, or refuse transactions to meet AML/CTF obligations.
6.3 Cashwo may report suspicious transactions to AUSTRAC without prior notice.
7.1 Business Users must maintain the confidentiality of portal credentials and notify Cashwo immediately of any unauthorised access.
7.2 Cashwo is not liable for losses arising from incorrect bank details or unauthorised transaction requests.
7.3 Unauthorized Transactions will be addressed under the e-Payments Code and Cashwo’s dispute resolution process.
7.4 If fraudulent access is suspected, users must contact support@cashwo.com.auimmediately
8.1 Business Users must report any transaction disputes within 30 days of the transaction date.
8.2 Disputes will be managed in accordance with AFCA guidelines.
8.3 For complaints, follow the procedure in the FSG.
9.1 Cashwo may suspend or terminate accounts for fraud, AML/CTF non-compliance, or breach of these Terms.
9.2 Business Users may request account cancellation at any time via the portal or by contacting support.
10.1 Cashwo’s liability is limited to the amount of the affected transaction, except where lawprohibits excluding liability.
10.2 Cashwo is not responsible for indirect, consequential, or special losses.
10.3 The Financial Claims Scheme does not apply to Cashwo services.
11.1 We adhere to the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy (www.cashwo.com.au/privacy-policy.html) explains how we collect, use, and disclose personal information.
These Terms are governed by the laws of Victoria, Australia, including but not limited to theAustralian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth) and the Electronic Transactions Act 2000 (Vic). These laws ensure that customers receive fair-trading protections, digital transaction integrity, and financial service transparency.
